1. Introduction
Welcome to CollectivePlains ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at collectiveplains.sbs (the "Service") operated by CollectivePlains.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
CollectivePlains offers upscale yacht charter services, which include but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
All offerings are subject to change based on availability and weather conditions, and we may alter or cancel services without prior notice.
3. Booking and Reservations
3.1 Booking Process
Charter booking requires you to:
- Be at least 18 years old
- Submit accurate and complete information
- Pay the required deposit outlined in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
Bookings are only secured once payment is received and confirmed by us in writing. We reserve the right to decline service to anyone at our discretion.
3.3 Availability
Charter availability depends on the vessel's schedule and favorable weather conditions. We strive to fulfill your requested dates and timing whenever possible.
4. Payment Terms
4.1 Pricing
Prices are provided in € and include all applicable taxes unless stated otherwise. We might adjust prices without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the full charter cost due upon booking
- Final Payment: Due 48 hours before the charter's scheduled departure
- Extra fees (if applicable): Due after the charter concludes
4.3 Payment Methods
Ranging from credit cards to bank transfers and certified checks, we offer a variety of payment options. All payments are processed using secure encrypted technology.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full refund minus any processing costs
- 24-72 hours before departure: 50% of the full refund
- Less than 24 hours before departure: No refund provided
5.2 Weather Cancellations
If the captain deems the weather unsafe, we will propose to:
- Reschedule to an alternative date without any additional charges
- Issue a full refund if rescheduling isn't an option
5.3 Mechanical Issues
Should your assigned yacht encounter mechanical issues, we'll endeavor to find a reasonable alternative. If this is not feasible, we'll issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are obliged to:
- Adhere to all commands given by the crew
- Wear assigned safety gear as needed
- Inform the crew of any medical conditions that could impact their safety
- Stay within the designated areas aboard the vessel
6.2 Prohibited Items
The following are not allowed on board:
- Glass containers
- Illegal substances
- Weapons or firearms
- Excessive amounts of non-alcoholic drinks beyond a reasonable amount of consumption
- Pets (unless pre-approved)
6.3 Conduct
Passenger behavior should be considerate and respectful at all times. We retain the right to discontinue a charter without a refund if a passenger’s conduct endangers safety or disturbs the experience for others.
7. Liability and Insurance
7.1 Our Liability
We are accountable only to the sum paid for the charter, and we are not responsible for:
- Injuries resulting from passenger negligence
- Items lost or damaged
- Indirect, resultant, or punitive losses
- Delays due to weather, or other circumstances we cannot control
7.2 Insurance Coverage
We hold comprehensive marine insurance policies for our fleet and operations. Charterers are advised to have their own travel and personal insurance.
7.3 Assumption of Risk
Partaking in our charters, you recognize the innate risks involved with maritime activities and you accept all responsibility for your safety and health.
8. Modifications and Itinerary Changes
We reserve the discretion to alter itineraries, paths, or schedules due to weather conditions, safety needs, or operational demands. Should changes occur, we will make all attempts to provide suitable alternative experiences.
9. Force Majeure
We shall not be held accountable for any alterations, delays, or cancellations caused by events beyond our control such as:
- Extreme weather phenomena
- Natural calamities
- Government directives
- Port shutdowns
- Mechanical failures
10. Privacy and Data Protection
Your private data is managed according to our Privacy Policy. Utilizing our services signifies your consent to the gathering and application of your information as depicted in the said policy.
11. Intellectual Property
The content on our site—textual, visual, or otherwise—is under the protection of copyright and trademark law. Unauthorized copying, distribution, or creation of works off this content is strictly prohibited without our written consent.
12. Governing Law
The laws of Spain oversee these Terms and any disputes will be settled within the courts of Barcelona, Spain.
13. Changes to Terms
Terms are subject to change at our will. Adaptations will be notified via our website and be dated accordingly. Your continued engagement with our services following modifications signifies your acceptance of the new terms.
